
Deposit:
In order to reserve a private dining room, the specified deposit must be received, along with this signed agreement. The deposit will be credited on the bill at the conclusion of the event. No reservation is confirmed until this agreement is signed by an authorized representative of Beacon Grille.
Service Charges, Minimums, and Taxes:
Room charges are not assessed for the use of our private dining rooms, although minimum food revenue requirements apply, as the restaurant’s dining room(s) are otherwise used for a la carte dining. Minimum food revenue requirements apply to food and beverage items only, and do not include sales taxes, gratuities, or peripheral rentals or purchases. All special events will be assessed state sales tax and 18 percent gratuity, based on total event sales. Beacon Grille accepts only cash and/or major credit cards for payment.
Estimated and Final Count:
An estimated guest count is required to reserve space for an event. A final guest count is due at least 72 hours before the date of the event. Billing will be based on the final count or the actual number in attendance, whichever is greater.
Billing and Collection:
Guest agrees to be responsible for all charges as specified on this Private Dining Order, and agrees to pay all outstanding balances for the event immediately at its conclusion. Beacon Grille will accept cash and/or major credit cards for final payment, but cannot accept personal checks as payment under any circumstances. If payment is not received within the stated time frame, Guest hereby authorizes Beacon Grille to charge the balance due to the credit card presented by Guest in connection with confirming the event (“Guest’s Credit Card”). Any organization recognized by the IRS as tax-exempt should attach a copy of its tax-exempt certificate to this Private Dining Order to qualify for the tax exemption.
Cancellation Policy:
A late cancellation of an event usually precludes the room’s use by another party. If Guest cancels an event, and so notifies Beacon Grille less than one month prior to the scheduled date, 50 percent of the deposit will be refunded. Cancellations within one week of the event will result in forfeiture of the entire deposit. Guest further agrees that failure to appear for the scheduled event without having provided Beacon Grille with at least 72 hours advance notice will result in Guest’s Credit Card being charged the entire estimated food revenue for the event, based on the final guest count. Atrium events (only) are subject to a $500 non-refundable administration fee, in the event of cancellation.
Conduct/Indemnification/Force Majeure:
Guest assumes full and complete responsibility for the conduct, acts, and omissions of all individuals in attendance at the event, and for any and all damage and/or injuries arising out of the acts or omissions of such individuals. Guest voluntarily agrees to waive, release, indemnify, and hold harmless Beacon Grille, its owners, affiliates, directors, officers, managers, employees, and agents from and against any injury, liability, loss, damage, costs, and expense (including reasonable attorneys’ fees) and for any demand, claim, action, or suit of any nature, unless such liability arises solely out of the negligence of Beacon Grille. Beacon Grille, in arranging the event for Guest, shall not be liable for any injury, loss, damage, expense, claim, action, suit of any kind, accident, delay, or irregularity arising from acts of God or circumstances beyond its control, including but not limited to strikes, civil disturbances, violent or terrorist activity by foreign or domestic agents, weather conditions, any act or omission of Beacon Grille’s subcontractors, delays due to changes in schedules, or changes authorized by Guest. In addition, Beacon Grille assumes no responsibility for the personal property of Guest or any others in attendance at Guest’s event, or for special or consequential damages of any sort.
General:
Homemade special occasion cakes and pastries may always be ordered through Beacon Grille, but cakes may also be brought in by Guest from any licensed bakery. When served with any luncheon or dinner, Beacon Grille will provide the servers, as well as needed plates and flatware, at no charge. Guest decorations are always subject to Beacon Grille approval. By law, alcoholic beverages may not be served before noon on Sundays, and may not be brought into or taken from the building by Guest or others in attendance at Guest's event. Irrespective of the amount of wine ordered, guests are never charged for unopened bottles. Beacon Grille fully adheres to city and state smoking regulations. Smoking is prohibited anywhere inside any public building in Massachusetts.
Authority to Sign this Agreement:
If this agreement is signed in the name of a business, legal, or governmental entity or association, the person signing this agreement affirmatively represents and warrants to Beacon Grille that he or she has full authority to sign this agreement and agrees that such representation shall be binding in all respects. |
